Introduction

Welcome to MSR Medical Ltd and thank you for choosing us to provide your selected training course. 

Please take time to read all of our legal terms and conditions before going forward; you will be bound by them when you register your details with us and when purchasing courses and/or materials. Please read these terms and conditions carefully before using our website or training courses. If you do not agree to these terms, please do not use our website or book any courses with us as this may not suit your needs.

Please be advised we amend and adjust our terms and conditions from time to time. Please read all legal statements provided by MSR Medical Ltd as they are subject to review, and may have changed as you are legally bound by them. Certain areas of our website and course information may be subject to additional terms and conditions but you will be informed of this on those pages or at the time of booking and/or before a training course is started.

Privacy Policy

We regard your privacy with utmost importance along with any details that we collect from you under the GDPR process. If you have chosen to provide them to us it helps and enables us to send you information about products and services. When, or if, you have registered an interest your details will be processed in accordance with GDPR. Please view our Privacy Policy for further information.

By providing us with your information you consent to us processing it for the purposes outlined in our Privacy Policy.

It is a requirement of using our services that at all times you will provide true and accurate details in registration forms, and/or other information request points on our registration, and/or application process. Please note we do not share any information with third parties, unless deemed necessary, as stated in our Privacy Policy

If you provide MSR Medical Ltd or we have reasonable grounds to suspect that you have provided any information that is untrue, inaccurate, not current or incomplete, MSR Medical Ltd has the right to suspend and/or terminate your use of our training courses that are currently booked, or currently attended and we can refuse any or all current or future use of the courses or training.

Transfer And Cancellation of Training Course

Students / Attendees / Employers may transfer their registration for one course to another course (depending on availability) up to 14 full days prior to the original course date. Once a named person has transferred no refunds can be made for the cancellation of either course. Only one transfer by any named person may be made per course booked.

If you cancel a Training Course: - all cancellations must be made no later than 7 full working days before the start of relevant Training Course. We will only accept cancellations that are made in writing and/or email prior to the 7 day off. If a Student fails to attend a training course, or a cancellation is sought within the 7 full working days prior to the start of such course, full payment will be required and no refund given.

Refund Policy: if the refund is approved by MSR Medical Ltd Ltd, it will be made through the original mode of payment only. No refunds shall be given in any other format 

If we cancel a Training Course, or change course content: - we reserve the right to cancel a Training Course at any time, without incurring any additional liability to MSR Medical Ltd Ltd or any Student / Attendee / Employer . In such circumstances, we will offer alternative dates, a full refund or a credit note.

Terms of Payment

Payment can only be made using an authorised credit/debit card via the online payment system (website) or bank transfer or by invoice (previously agreed terms). Receipts for payment are provided via email or paper copy (admin charge for paper copy £1.50 per person).

All courses must be paid in full 7 full days before the selected course start date. Any other agreement and/or invoice (previously arranged and contract signed) raised must be paid within 30 working days of the course. No Certificates will be issued until full payment is made.

If any pre-course payment is late (paid after the 7 full working days) the course could and/or will be cancelled without notice. Late Payment Fee’s will apply at a Rate of 10% of full course costs (unless otherwise agreed in writing).

If payment is still not made post course, MSR Medical Ltd will commence legal action against Named Person/s, Employers and/or business/s for full costs of selected courses (Per Person/Per course) and legal/professional fees will be applied to the existing invoice after 60 days from invoiced date.

If any information that you have given to us proves to be incorrect, which has resulted in our not charging you the correct fee for the courses that you are buying, we reserve the right to adjust the fee (upwards or downwards) so that it is the correct fee for your circumstances.

MSR Medical Ltd - Liability 

Nothing in this Licence shall exclude or in any way limit the MSR Medical Ltd liability for fraud, and/or for death and/or personal injury caused by its negligence, or any other liability to the extent that it may not be excluded or limited as a matter of law.

MSR Medical Ltd shall not be liable under, and/or in connection with this Licence and/or any collateral contract for:

• loss of income;

• loss of business profits or contracts;

• business interruption;

• loss of the use of money or anticipated savings;

• loss of information;

• loss of opportunity, goodwill or reputation;

• loss of, damage to or corruption of data; or

• any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise;

Except for matters caused by MSR Medical Ltd’s negligence or wilful default (or that of its employees and agents), MSR Medical Ltd shall not be liable to you for any loss, harm or damage caused to any candidate, candidate’s property or your premises for any courses conducted by the MSR Medical Ltd on your premises. 

You agree to indemnify and hold harmless, against all cost or losses suffered or incurred by the company due to claims, demands, suits, proceedings, actions, losses, judgments, damages, costs (including all reasonable legal fees), expenses, fines or penalties or actions against the company arising out of or relating to a third party's any alleged harm, loss or damage caused to a candidate’s person, property, or to your premises on which the course relevant to such candidate takes place, due to any cause other than the company’s negligence or wilful default (or that of its employees and agents).

These terms set out the full extent of the MSR Medical Ltd obligations and liabilities in respect of the supply of the Training Courses, Training Materials and Documentation. In particular, there are no conditions, warranties, representations or other terms, express or implied, that are binding on the company except as specifically stated in this Licence.

Please ensure all documentation is thoroughly read, agreed by all parties and signed and returned to us within 7 days of receipt via post and/or email (signed, scanned and sent).
